Confidential communication with mediator

Section 49
(1)
No person shall be compelled to disclose to the court any confidential communication which has taken place between that person and the mediator, if the mediation process fails.
(2)
Notwithstanding subsection (1), if that person offers himself as a witness in a trial involving any dispute that has been subjected to mediation under this Chapter, that person may be ordered by the court to disclose such communications in the mediation session only if the communication appears to the court necessary to explain any evidence which that person has given.
