Section 43

(1)
Subject to subsection (2), a mining lease may be granted over any State land.
(2)
Subject to section 32, no mining lease shall be granted in respect of any area within the prospecting area in respect of which a prospecting licence has been granted except with the written consent of the holder of such licence.
