LEMBAGA PELAWAT

Kewajipan dan fungsi Lembaga Pelawat

Seksyen 3

Kewajipan dan fungsi Lembaga Pelawat adalah seperti yang berikut:

(a)

untuk mengawasi perkembangan keseluruhan dan kesejahteraan penghuni, dan membuat syor kepada Ketua Pengarah, Pengarah Negeri, Pengarah atau

Pengetua tentang penambahbaikan bagi perkembangan keseluruhan dan kesejahteraan penghuni;

untuk mengawasi pentadbiran tempat selamat dan membuat syor kepada

Ketua Pengarah, Pengarah Negeri, Pengarah atau Pengetua tentang penambahbaikan pentadbiran tempat selamat bagi memastikan tujuan tempat selamat tercapai;

(c)

untuk mengadakan dana bagi aktiviti, latihan atau program yang dijalankan oleh tempat selamat;

(d)

untuk menganjurkan aktiviti atau program untuk meningkatkan perkembangan fizikal, kognitif, mental dan psikososial penghuni;

(e)

untuk menasihati Pengetua bagi memastikan persekitaran tempat selamat adalah selamat, bersih dan sesuai bagi penghuni;

Kuasa Lembaga Pelawat

(1)

Lembaga Pelawat hendaklah mempunyai kuasa untuk melakukan semua perkara yang perlu atau suai manfaat bagi atau berkaitan dengan pelaksanaan kewajipan dan fungsinya.

Tanpa menjejaskan keluasan subperaturan (1), kuasa Lembaga Pelawat hendaklah termasuk yang berikut:

(a)

untuk menjalankan pemeriksaan di tempat selamat untuk memastikan bahawa kesihatan, kebajikan dan perkembangan penghuni dijaga;

untuk membuat apa-apa perundingan, perjanjian atau perkiraan dengan mana-mana orang yang difikirkan sesuai oleh Lembaga Pelawat dalam melaksanakan kewajipan dan fungsinya; dan

Suggest a correction

(c)

untuk mendapatkan nasihat daripada mana-mana institusi, organisasi, syarikat atau individu yang mempunyai pengalaman, pengetahuan dan kepakaran yang sepatutnya bagi maksud menganjurkan apa-apa aktiviti, latihan atau program di tempat selamat.

Keanggotaan Lembaga Pelawat

Seksyen 5

(1)

Lembaga Pelawat hendaklah terdiri daripada tidak kurang daripada tujuh orang anggota dan tidak lebih daripada lima belas orang anggota.

Anggota Lembaga Pelawat hendaklah sekurang-kurangnya tiga orang perempuan dan tiga orang lelaki.

Menteri hendaklah melantik seorang Pengerusi Lembaga Pelawat dalam kalangan anggota Lembaga Pelawat.

(4)

Bagi maksud keanggotaan Lembaga Pelawat, orang yang berikut tidak boleh menjadi anggota Lembaga Pelawat:

(a)

mana-mana kakitangan dan suami atau isterinya; dan

(b)

mana-mana kakitangan Jabatan Kebajikan Masyarakat dan suami atau isterinya.

Seksyen 6

(1)

Seseorang anggota Lembaga Pelawat hendaklah, melainkan jika dia terlebih dahulu meletakkan atau mengosongkan jawatannya atau pelantikannya dibatalkan terlebih dahulu, memegang jawatan bagi tempoh tidak melebihi tiga tahun dan layak untuk dilantik semula.

Pelantikan semula yang disebut dalam subperaturan (1) hendaklah tertakluk kepada syarat yang berikut:

(a)

tempoh pelantikan semula itu tidak boleh melebihi dua penggal berturut-turut; dan

umur anggota itu tidak boleh melebihi tujuh puluh tahun.

Walau apa pun perenggan (2)(b), mana-mana anggota Lembaga Pelawat boleh dilantik semula jika difikirkan oleh Menteri bahawa anggota itu mempunyai pengalaman, pengetahuan dan kepakaran dalam perkara yang berhubungan dengan perkembangan, kebajikan dan kesihatan penghuni.

Anggota Lembaga Pelawat boleh dibayar apa-apa elaun sebagaimana yang ditentukan oleh Menteri.

Seksyen 8

Pembatalan dan peletakan jawatan

Menteri boleh, pada bila-bila masa, membatalkan pelantikan mana-mana anggota Lembaga Pelawat.

Mana-mana anggota Lembaga Pelawat boleh, pada bila-bila masa, meletakkan jawatan dengan memberikan suatu notis bertulis satu bulan kepada

Menteri.

Mesyuarat dan tatacara Lembaga Pelawat

Lembaga Pelawat hendaklah mengadakan mesyuaratnya tidak kurang daripada enam kali setahun pada bila-bila masa dan di mana-mana tempat sebagaimana yang ditentukan oleh Pengerusi.

Semua mesyuarat Lembaga Pelawat hendaklah dipengerusikan oleh

Pengerusi atau, semasa ketiadaan Pengerusi, mana-mana anggota Lembaga Pelawat.

Lembaga

Pelawat boleh mengundang mana-mana pegawai

Jabatan Kebajikan Masyarakat atau mana-mana orang yang mempunyai kepakaran yang berkaitan untuk menghadiri mana-mana mesyuaratnya, dan pegawai atau orang itu boleh mengambil bahagian dalam perbincangan semasa mesyuarat itu tetapi tidak berhak untuk mengundi.

Kuorum bagi mesyuarat Lembaga Pelawat ialah majoriti mudah daripada jumlah bilangan anggotanya.

Keputusan Lembaga Pelawat hendaklah diterima pakai melalui undi majoriti mudah anggota yang hadir dan mengundi, dan dalam hal bilangan undi yang sama banyak, Pengerusi atau mana-mana anggota yang mempengerusikan mesyuarat hendaklah mempunyai undi pemutus.

Lembaga Pelawat hendaklah menyebabkan supaya—

(a)

minit mesyuaratnya disimpan dan disenggarakan dalam bentuk yang sepatutnya; dan

(b)

salinan minit mesyuaratnya dikemukakan kepada Ketua Pengarah,

Pengarah Negeri dan Pengarah dengan seberapa segera yang dapat dilaksanakan.

Lembaga Pelawat boleh melantik mana-mana orang untuk menjadi anggota mana-mana jawatankuasa yang ditubuhkan di bawah subperaturan (1).

Lembaga Pelawat hendaklah menentukan kewajipan dan fungsi tiap-tiap jawatankuasa yang ditubuhkan di bawah subperaturan (1) dan tiap-tiap jawatankuasa yang ditubuhkan hendaklah dipengerusikan oleh seorang anggota Lembaga Pelawat.

Jawatankuasa yang ditubuhkan di bawah peraturan 10 hendaklah menyebabkan supaya—

(a)

minit mesyuaratnya disimpan dan disenggarakan dalam bentuk yang sepatutnya; dan

salinan minit mesyuaratnya dikemukakan kepada Lembaga Pelawat dengan seberapa segera yang dapat dilaksanakan.

Seksyen 12

Jawatan seseorang anggota Lembaga Pelawat atau jawatankuasa yang ditubuhkan di bawah peraturan 10 hendaklah menjadi kosong jika—

(b)

telah dibuktikan terhadapnya, atau dia telah disabitkan atas, suatu pertuduhan berkenaan dengan—

kesalahan yang melibatkan fraud, kecurangan atau keburukan akhlak;

(ii)

kesalahan di bawah mana-mana undang-undang bertulis yang berhubungan dengan rasuah; atau

(iii)

mana-mana kesalahan lain yang boleh dihukum dengan pemenjaraan, sama ada pemenjaraan sahaja atau sebagai tambahan kepada denda atau sebagai ganti denda, selama lebih daripada dua tahun;

dia menjadi tidak sempurna akal atau selainnya tidak berupaya menunaikan kewajipannya;

untuk melawat dan memeriksa tempat selamat sekurang-kurangnya empat kali setahun;

untuk memberikan pertimbangan yang sewajarnya kepada semua perkara dan syor yang dibawa ke hadapannya oleh Lembaga Pelawat di bawah peraturan 3; dan

(c)

untuk menentukan bilangan penghuni yang hendak dimasukkan ke suatu tempat selamat.

Bilangan penghuni di suatu tempat selamat tidak boleh melebihi bilangan penghuni sebagaimana yang ditentukan oleh

Ketua

Pengarah di bawah perenggan (1)(c) melainkan jika kelulusan Ketua Pengarah diperoleh terlebih dahulu.

untuk menggalakkan perkembangan, kebajikan dan kesihatan penghuni;

untuk memastikan bahawa persekitaran tempat selamat adalah selamat, bersih dan sesuai bagi penghuni;

untuk mengadakan program pemeliharaan dan perlindungan untuk penghuni termasuklah pendidikan, kemahiran hidup dan latihan vokasional;

(e)

untuk mengawasi kelakuan dan disiplin penghuni;

(f)

untuk menentukan kewajipan kakitangan dan mengawasi pelaksanaan kewajipan itu; dan

(g)

untuk melakukan apa-apa perkara lain sebagaimana yang diarahkan oleh Ketua Pengarah.

Bagi maksud perenggan (1)(c), Pengetua hendaklah memastikan bahawa garis panduan keselamatan yang berhubungan dengan pencegahan kebakaran, bencana alam atau hal keadaan kecemasan yang disediakan oleh pihak berkuasa yang berkaitan dipatuhi.

Bagi maksud perenggan (1)(e), jika mana-mana penghuni meninggalkan tempat selamat tanpa kelulusan bertulis Pengetua terlebih dahulu atau lepas lari dari tempat selamat, Pengetua hendaklah, dalam tempoh dua puluh empat jam selepas mengetahui hakikat itu, melaporkan perkara itu kepada—

Pelindung bagi kawasan di mana penghuni itu tinggal; atau

ibu atau bapa, penjaga atau saudara penghuni itu.

Dalam menjalankan kewajipan yang disebut dalam subperaturan (1),

Pengetua hendaklah menyediakan suatu laporan bulanan bagi tempat selamat yang hendaklah termasuk perkara yang berikut:

(c)

penghuni yang telah meninggalkan tempat selamat tanpa kelulusan terlebih dahulu atau telah lepas lari dari tempat selamat;

derma atau hadiah yang diterima oleh tempat selamat;

(h)

kelemahan yang berhubungan dengan pentadbiran tempat selamat;

dan

(i)

aktiviti atau program yang dianjurkan oleh Lembaga Pelawat.

Laporan bulanan yang disebut dalam subperaturan (4) hendaklah—

(a)

dibentangkan oleh Pengetua kepada Lembaga Pelawat dalam mesyuaratnya; dan

(b)

dikemukakan oleh Pengetua kepada Ketua Pengarah, Pengarah Negeri dan Pengarah tidak lewat daripada hari kesepuluh bulan berikutnya.

Jika Pengetua tidak hadir di tempat selamat lebih daripada dua puluh empat jam, dia hendaklah—

(a)

mendapatkan suatu kelulusan bertulis terlebih dahulu daripada

Pengarah Negeri; dan

melantik mana-mana kakitangan yang kanan dan berpengalaman secara bertulis untuk menjalankan kewajipannya semasa tempoh ketiadaannya.

BAHAGIAN IV

Seksyen 16

Jika apa-apa parut atau kecederaan dijumpai pada badan penghuni dalam pemeriksaan yang dijalankan di bawah subperaturan (1), gambar parut atau kecederaan itu hendaklah diambil dan apa-apa butir-butir yang berhubungan dengan parut atau kecederaan itu hendaklah direkodkan oleh kakitangan dalam fail peribadi penghuni itu.

Jika apa-apa bahan larangan dijumpai dalam pemeriksaan yang dijalankan di bawah subperaturan (1), bahan larangan itu hendaklah dirampas oleh Pengetua dan dia hendaklah menyebabkan rampasan itu direkodkan dalam fail peribadi penghuni itu.

Suatu inventori bagi barang peribadi penghuni yang disebut dalam subperaturan (1) hendaklah—

ditentusahkan oleh penghuni itu dan disaksikan oleh seorang kakitangan.

Bagi maksud perenggan (2)(b), jika inventori bagi barang peribadi penghuni tidak dapat ditentusahkan oleh penghuni itu disebabkan umur penghuni itu, inventori itu hendaklah ditentusahkan oleh Pelindung dan disaksikan oleh seorang kakitangan.

Tiap-tiap penghuni tempat selamat hendaklah—

mematuhi apa-apa arahan yang diberikan oleh Pengetua dari semasa ke semasa;

menghadiri apa-apa aktiviti, latihan atau program yang dijalankan oleh tempat selamat itu; dan

mengekalkan kelakuan baik sepanjang tempoh peletakan di tempat selamat itu.

Kesihatan penghuni

Jika pegawai perubatan atau pegawai pergigian berpendapat bahawa penghuni itu memerlukan pemeriksaan atau rawatan perubatan atau pergigian lanjutan di hospital, Pengetua hendaklah membuat perkiraan bagi penghuni itu untuk mendapat pemeriksaan atau rawatan lanjut di hospital.

Jika penghuni dimasukkan ke hospital, penghuni itu hendaklah disifatkan sebagai berada di bawah jagaan Pengetua semasa tempoh kemasukan ke hospital itu.

pendidikan awal kanak-kanak, atau pendidikan rendah atau menengah;

Bagi maksud menyediakan pendidikan awal kanak-kanak, atau pendidikan rendah atau menengah kepada penghuni di bawah perenggan (1)(a), Pengetua hendaklah menyediakan yang berikut:

Bagi maksud menyediakan latihan teknikal atau vokasional, atau latihan kemahiran hidup di bawah perenggan (1)(b) atau (c), mengikut mana-mana yang berkenaan, Pengetua hendaklah—

(a)

mengambil kira keupayaan dan kebolehan penghuni; dan

(b)

berunding dengan ibu atau bapa atau penjaga penghuni.

Bagi maksud menyediakan program pembangunan moral dan rohani di bawah perenggan (1)(d), Pengetua hendaklah memastikan supaya penghuni—

(a)

menyertai apa-apa aktiviti atau program mengikut kepercayaan agama penghuni itu;

menyertai apa-apa aktiviti atau program lain sebagaimana yang ditentukan oleh Pengetua.

Mana-mana orang yang bertanggungjawab untuk menyediakan pendidikan, latihan atau program yang disebut dalam subperaturan (1) hendaklah menyediakan laporan kemajuan bagi setiap penghuni yang menjalani pendidikan, latihan atau program itu dan mengemukakan laporan itu kepada Pengetua.

Pengetua hendaklah memastikan laporan kemajuan itu disimpan di dalam fail peribadi penghuni.

Jadual waktu aktiviti harian

Suatu salinan jadual waktu aktiviti harian hendaklah ditampalkan pada papan notis utama, dan di dewan makan dan pejabat, tempat selamat itu.

Apa-apa perubahan besar yang dibuat kepada jadual waktu aktiviti harian itu hendaklah dimasukkan ke dalam buku log dan suatu pemberitahuan bertulis mengenai perubahan itu hendaklah dikemukakan kepada Ketua Pengarah dengan segera.

hendaklah bersesuaian dengan umur dan keupayaan penghuni dan hendaklah memberikan peluang bagi perkembangan mereka; dan

hendaklah termasuk tempoh bagi aktiviti dalam dan luar dan tempoh bagi rehat yang tidak diganggu.

Kakitangan hendaklah merekodkan kehadiran setiap penghuni ke aktiviti harian atau program dan ketidakhadirannya daripada aktiviti harian atau program itu dalam suatu daftar.

Seksyen 23

Pengetua boleh memberi tiap-tiap penghuni wang saku secara tunai bagi amaun sebagaimana yang diluluskan oleh Ketua Pengarah dan tertakluk kepada apa-apa syarat yang dikenakan oleh Ketua Pengarah.

Hadiah, derma dan pendapatan

apa-apa derma, dan pendapatan yang diperoleh daripada apa-apa aktiviti, latihan atau program yang diluluskan, dalam suatu akaun simpanan yang dibuka untuk penghuni itu, tertakluk kepada apa-apa syarat yang dikenakan oleh Ketua Pengarah.

Walau apa pun subperaturan (1), tiada penghuni boleh diambil bekerja dengan sebegitu rupa sehingga menyebabkan dia tidak mendapat masa untuk berekreasi dan masa lapang.

Rekreasi

Pengetua hendaklah menggalakkan semua penghuni untuk menyertai apa-apa aktiviti atau program rekreasi yang termasuklah permainan yang diaturkan, aktiviti sosial, rombongan sosial atau lawatan sosial di luar tempat selamat.

Cuti

Cuti yang disebut dalam subperaturan (1) tidak boleh diberikan kepada penghuni—

(a)

dalam masa enam bulan pertama peletakan di tempat selamat kecuali disebabkan berlakunya apa-apa hal keadaan luar biasa dan dengan kelulusan Pengetua; atau

(b)

melebihi tiga puluh hari kecuali disebabkan berlakunya apa-apa hal keadaan luar biasa dan dengan kelulusan Pengarah Negeri.

Cara komunikasi yang disebut dalam subperaturan (1) hendaklah diawasi oleh Pengetua.

  1. IN exercise of the powers conferred by sections 82 and 128 of the Child Act 2001 [Act 611], the Minister makes the following regulations:

Interpretation 2.

In these Regulations, unless the context otherwise requires―

“Committee” means the Disciplinary and Intervention Advisory Committee established under regulation 34;

“staff” means any staff of a place of safety;

“dental officer” means a registered dental practitioner in the service of the

Government;

“Director” means the Director of Children Division of the Department of Social

Welfare;

“Chairman” means the Chairman of the Board of Visitors appointed under regulation 5;

“inmate” means any child who is placed in a place of safety.

BOARD OF VISITORS

The duties and functions of the Board of Visitors shall be as follows:

an offence under any written law relating to corruption; or

(c)

he is of unsound mind or otherwise incapable of discharging his duties;

(e)

in respect of a member of the Board of Visitors, he absents himself from three consecutive meetings of the Board of Visitors without leave of the

Chairman, and in respect of a member of a committee established under regulation 10, he absents himself from three consecutive meetings of the committee without leave of the chairman of the committee;

(f)

in respect of a member of the Board of Visitors, his appointment is revoked by the Minister, and in respect of a member of a committee established under regulation 10, his appointment is revoked by the Board of Visitors; or

(a)

to supervise on the overall development and well-being of the inmates, and make recommendations to the Director General, State Director, Director or

Principal on the improvement of the overall development and well-being of the inmates;

(b)

to supervise on the administration of the place of safety and make recommendations to the Director General, State Director, Director or

Principal on the improvement of the administration of the place of safety in ensuring that the purpose of the place of safety is fulfilled;

(c)

to provide fund for the activities, trainings or programmes conducted by the place of safety;

Suggest a correction

(d)

to organize activities or programmes to improve the physical, cognitive, mental and psychosocial development of the inmates;

(e)

to advise the Principal in ensuring that the environment of the place of safety is safe, clean and suitable for the inmates;

(f)

to advise the Director General on any matter relating to the care, protection and development of the inmates;

to inform the Director General of any weaknesses in the care and protection programme or any other programme conducted in the place of safety;

(h)

to visit the place of safety at least once a month; and

Suggest a correction

(i)

to do such other things as may be directed by the Minister.

Powers of Board of Visitors 4.

(1)

The Board of Visitors shall have the power to do all things necessary or expedient for or in connection with the performance of its duties and functions.

Without prejudice to the generality of subregulation (1), the powers of the

Board of Visitors shall include the following:

(a)

to conduct inspection at the place of safety to ensure that the health, welfare and development of the inmates are cared for;

(b)

to enter into any negotiation, agreement or arrangement with any person that the Board of Visitors thinks fit in performing its duties and functions; and

Suggest a correction

(c)

to seek advice from any institution, organization, company or individual with the appropriate experience, knowledge and expertise for the purpose of organizing any activity, training or programme in the place of safety.

Membership of Board of Visitors 5.

(1)

The Board of Visitors shall consist of not less than seven members and not more than fifteen members.

The members of the Board of Visitors shall be at least three women and three men.

The Minister shall appoint a Chairman of the Board of Visitors amongst the members of the Board of Visitors.

For the purposes of membership of the Board of Visitors, the following persons shall not be a member of the Board of Visitors:

any staff of the Department of Social Welfare and his spouse.

Tenure of office 6.

(1)

A member of the Board of Visitors shall, unless he sooner resigns or vacates his office or his appointment is sooner revoked, hold office for a term not exceeding three years and may be eligible for reappointment.

(2)

The reappointment referred to in subregulation (1) shall be subject to the following conditions:

(a)

the term of the reappointment shall not exceed two consecutive terms;

and

(b)

the age of the member shall not exceed seventy years.

(3)

Notwithstanding paragraph (2)(b), any member of the Board of Visitors may be reappointed if the Minister thinks that the member has the experience, knowledge and expertise in matters relating to the development, welfare and health of the inmates.

Allowances 7.

The members of the Board of Visitors may be paid such allowances as may be determined by the Minister.

Revocation and resignation 8.

The Minister may, at any time, revoke the appointment of any member of the

Board of Visitors.

Any member of the Board of Visitors may, at any time, resign by giving one month written notice to the Minister.

Meetings and procedures of Board of Visitors 9.

(1)

The Board of Visitors shall convene its meetings not less than six times in a year at such time and place as the Chairman may determine.

All meetings of the Board of Visitors shall be presided by the Chairman or, in the absence of the Chairman, any members of the Board of Visitors.

(3)

The Board of Visitors may invite any officer of the Department of Social

Welfare or any person with relevant expertise to attend any of its meetings, and such officer or person may take part in the discussions during the meeting but shall not be entitled to vote.

(4)

A quorum for a meeting of the Board of Visitors shall be a simple majority of the total number of its members.

(5)

The decisions of the Board of Visitors shall be adopted by a simple majority of votes of the members present and voting, and in the case of an equality of votes, the

Chairman or any member presiding the meeting shall have a casting vote.

The Board of Visitors shall cause—

(a)

the minutes of its meetings to be kept and maintained in a proper form;

and

(b)

copies of the minutes of its meetings to be submitted to the

Director General, State Director and Director as soon as practicable.

ADMINISTRATION OF PLACE OF SAFETY

The number of inmates in a place of safety shall not exceed the number of inmates as determined by the Director General under paragraph (1)(c) unless prior approval of the Director General has been obtained.

to promote the development, welfare and health of the inmates;

to ensure that the environment of the place of safety is safe, clean and suitable for the inmates;

to provide care and protection programmes for the inmates including education, living skill and vocational training;

(e)

to supervise the conduct and discipline of the inmates;

(f)

to determine the duties of the staff and supervise the performance of such duties; and

(g)

to do any other things as directed by the Director General.

For the purposes of paragraph (1)(c), the Principal shall ensure that the safety guidelines relating to fire prevention, natural disaster or emergency circumstances provided by the relevant authority are complied with.

For the purposes of paragraph (1)(e), if any inmate leaves the place of safety without prior written approval of the Principal or escapes from the place of safety, the

Principal shall, within twenty-four hours after knowing such facts, report the matter to—

(b)

the Protector of the area in which the inmate lives; or

the parent, guardian or relative of the inmate.

In carrying out the duties referred to in subregulation (1), the Principal shall prepare a monthly report of the place of safety which shall include the following matters:

inmates who have left the place of safety without prior approval or have escaped from the place of safety;

donations or gifts received by the place of safety;

(h)

weaknesses relating to the administration of the place of safety; and

(i)

activities or programmes organized by the Board of Visitors.

The monthly report referred to in subregulation (4) shall be—

(a)

presented by the Principal to the Board of Visitors in its meeting; and

submitted by the Principal to the Director General, State Director and

Director not later than the tenth day of the following month.

If the Principal is absent from the place of safety for more than twenty-four hours, he shall—

(a)

obtain a prior written approval from the State Director; and

appoint any senior and experienced staff in writing to carry out his duties during the period of his absence.

If any scar or injury is found on the body of the inmate in the search conducted under subregulation (1), the picture of the scar or injury shall be taken and any particulars relating to the scar or injury shall be recorded by the staff in the personal file of the inmate.

If any prohibited substance is found in the search conducted under subregulation (1), the prohibited substance shall be confiscated by the Principal and he shall cause the confiscation to be recorded in the personal file of the inmate.

An inventory of the personal belongings of an inmate referred to in subregulation (1) shall be—

For the purpose of paragraph (2)(b), if the inventory of the personal belongings of the inmate could not be verified by the inmate due to the age of the inmate, the inventory shall be verified by the Protector and witnessed by the staff.

(a)

comply with any direction given by the Principal from time to time;

attend any activity, training or programme conducted by the place of safety;

and

maintain good behaviour throughout the placement period in the place of safety.

Health of inmates

If the medical officer or dental officer is of the opinion that the inmate requires further medical or dental examination or treatment in a hospital, the Principal

shall make an arrangement for the inmate to receive further examination or treatment in a hospital.

If an inmate is admitted to a hospital, the inmate shall be deemed to be under the custody of the Principal during the period of such admission in the hospital.

Education, skills, etc.

take into consideration the ability and capability of the inmate; and

For the purpose of providing moral and spiritual development programmes under paragraph (1)(d), the Principal shall ensure that an inmate—

(a)

participates in any activity or programme according to the inmate’s religious belief;

participates in any other activities or programmes as determined by the Principal.

Any person who is responsible for providing the education, trainings or programmes referred to in subregulation (1) shall prepare the progress reports for each inmate who undergoes the education, trainings or programmes and submit such reports to the Principal.

The Principal shall ensure that the progress report is kept in the personal file of the inmates.

Timetable of daily activities

A copy of the timetable of daily activities shall be posted on the main notice board, and at the dining hall and office, of the place of safety.

during the first six months of the placement in the place of safety except due to the occurrence of any exceptional circumstances and with the approval of the Principal; or

a bed including a mattress, pillow, bed sheet, pillow case and blanket;

The dietary scale shall include a menu appropriate to the age and health of each inmate.

The Principal shall ensure that—

(a)

any inmate who has been recommended with a special dietary food by a dietician or medical officer is supplied with the recommended food;

proper arrangements are made for the preparation, cooking and serving of food in accordance with the religion, belief or custom of the inmates;

the cleanliness of food at the time of preparation and serving; and

(d)

the inmates are taught to be courteous and well-behaved during meals.

A copy of the dietary scale and menu shall be posted at the kitchen, dining hall and office of the place of safety.

religious instructions are observed by the inmates; and

Notwithstanding paragraph (1)(e), the inmates may be allowed to use a sharp object under the supervision of the staff for the purposes of technical or vocational training or living skills training.

leave the place of safety without prior written approval of the Principal or, in the absence of the Principal, any senior and experienced staff appointed by the Principal; or

Any inmate who breaches the discipline under regulation 35, 36 or 37 shall be referred to the Committee.

For the purposes of paragraph (1)(b), the additional work imposed on an inmate—

(a)

shall not be harmful to the health of the inmate; and

Upon discharge of an inmate from the place of safety, the Principal shall ensure that the inmate is returned to his parent or guardian together with the inmate’s documents and personal belongings.

such other records as may be required by the Director General.

All records referred to in subregulation (1) shall be made available for inspection by the Director General or his representative.

The existing members of the Board of Visitors appointed by the Minister under regulation 3, and the existing members of the committee appointed by the

Board of Visitors under regulation 8, of the Child (Places of Safety) Regulations 2007

[P.U. (A) 368/2007], which are referred to as the “revoked Regulations” under this regulation, shall be deemed to have been duly appointed under these Regulations and shall continue to hold office until the appointments are revoked or vacated, or until the expiry of their terms of appointments.

Any disciplinary action taken under the revoked Regulations which is still pending before the coming into operation of these Regulations shall continue to be valid and shall be dealt with under the revoked Regulations as if the revoked Regulations had not been revoked.
