Opening note
Preamble
- In exercise of the powers conferred by sections 30, 31 and 33 of the Sabah Ports Authority Enactment 1967, the Sabah Ports Authority hereby makes the following regulations:
Section 1
Citation and commencement.
These Regulations may be cited as the Sabah Ports Authority (Scale of Dues and Charges) Regulations 1977 and shall come into force on the first day of July 1977.
Section 2
Interpretation.
In these Regulations-
(a)
"GRT" means the Gross Registered Tonnage;
(aa) “normal working hours” means working hours of the 1st and 2nd shifts on a normal working day excluding the meal breaks;
(b)
"Port" means any place declared to be a port under section 3 of the Sabah Ports Authority Enactment 1981;
(c)
"Prescribed Holidays" means the Prescribed Holidays for Workers as prescribed under the Labour Ordinance
[Cap. 67];
(d)
"Public Holidays" means the Public Holidays as prescribed under the Holidays Ordinance [Cap. 56.];
(dd)
“shift” means eight (8) working hours which is divided by a meal break into two work period;
(f)
"the Authority" means the Sabah Ports Authority established under section 4 of the Sabah Ports Authority
Enactment 1981.
Section 3
Port Dues.
The master or owner of every vessel, other than a vessel exempt under the provisions of sub-section (2) of section 40 of the
Enactment, which enters a port or the approaches to a port and the master or owner of a harbour craft shall pay to the Authority port dues according to the scale specified in Part I of the Schedule.
Section 4
Loading and discharging charges.
There shall be paid such charges as specified under Part II of the Schedule in respect of a vessel for loading or discharging cargoes or using any of the Authority's wharves.
Section 5
Handling charges.
A shipper or consignee whose goods are handled at any of the Authority's wharves or premises or at anchor shall pay to the
Authority the charges as specified under Part III of the Schedule.

Section 6
General services charges.
There shall be paid to the Authority in respect of general services provided by the Authority such charges as specified under
Part IV of the Schedule.
Section 6A
Container charges.
There shall be paid to the Authority the Container Charges as specified under Part V of the Schedule.
Section 7
Bunkers and lubricants.
It shall be lawful for the Authority to charge at an appropriate cargo rate in respect of any bunkers and lubricants taken on board a vessel alongside an Authority wharf.
Section 8
Payment when due.
Unless otherwise agreed upon between the Authority and any party in relation to the provision of credit facilities.
(a)
charges in respect of goods to be landed shall be payable immediately on the landing of such goods;
(b)
charges in respect of goods to be shipped shall be payable before such goods are shipped; and
(c)
charges in respect of goods to be removed from the premises of the Authority shall be payable before such goods are removed.
Section 9
Method of calculating tonnage.
For the purposes of calculating port dues and charges leviable by the Authority all tonnage shall be calculated according to the cubic measurement or gross weight whichever is the greater. Should particulars of the tonnage be incorrectly furnished to the
Authority, the charges payable shall be based on the tonnage assessed by the Authority either by weighing, measurement or estimation.
Section 10
Repeal.
The Sabah Ports Authority (Dues and Charges) Regulations 1976 [G.N.S 2 of 1967.] is hereby repealed.

Where any vessel having been allocated a berth remains thereat for a period longer than is permitted and has failed to comply with a notice in writing given to the master, officer-in-charge of the vessel or its agent to leave that berth, a charge shall be made against such vessel at the rate of RM15.00 per 100 GRT or part thereof per hour or part thereof.

Section 29
Free Storage Period
(1)
The Authority allows a free storage period of 72 hours as follows:
(a)
For inward cargo the 72-hour free storage period starts from midnight on the day of completion of discharge of the ship and finishes 72 hours thereafter. Cargo remaining in the Authority's custody after the aforesaid free period incurs storage charges.
(b)
For outward cargo the 72-hour free storage period starts from the time the cargo or any part of a particular consignment is received by the Authority and finishes 72 hours thereafter. Cargo remaining in the Authority's custody after the aforesaid free period incurs storage charges.
Section 30
Store Rent on Valuable Cargo
An ad valorem charge at the rate of one percent per day or part thereof for store rent shall be made for any package exceeding in value RM2,000 stored in the Authority's valuable cargo lock-up upon the express application of the consignee or shipper.

Reception/Delivery Outside Normal Working Hours

Special Surveys
(1)
Where the Authority is requested to carry out a special survey on behalf of a vessel, consignee, or shipper or other interested party, a fee of RM30.00 per survey for a period not exceeding one hour, will be charged. For each additional hour the charge will be
RM20.00.
(2)
On Prescribed Holidays the charges detailed at sub-item (1) above shall be increased by 100%.
Section 36
Cargo Measuring and Weighing
(1)
The Authority reserves the right to measure or weigh the cargo where it deems necessary to check the accuracy of the manifested weight and/or measurement specified in the manifest. If the manifested weight and/or measurement is found to be short declared the following charges shall be payable by the port users concerned:

Where a consignment has been weighed or the weight thereof has been assessed and the consignor or consignee wishes to verify the weight so arrived at, the Authority shall, whenever possible, weigh' or re-weigh the consignment, and where such weighing or re-weighing reveals no difference in weight greater than one per cent of the total gross weight of the consignment, shall charge for the weighing or re-weighing service so rendered at the rate of 50% of the charges detailed at sub-item (1) (a) and (c) above.
(3)
The charges specified at sub-item (1)(a), (b) and (c) shall apply where the measuring or weighing is carried out at the request of the vessel, consignee, shipper or owner of goods and payable by the party making the request. In the case of weighing under this sub-item the weight shall be the weight of the vehicle and the cargo carried by the vehicle, if any.
(4)
On Prescribed Holidays the charges detailed at sub-items (1) to (3) above shall be increased by 100%.
(5)
The charges for the use of the Authority’s weighbridge shall be RM5.00 per weighing.
Section 37
Rent of Space for Sorting, etc..
Consignees and other parties may rent space in the Authority's premises for the purpose of sorting, checking or re-bagging cargo or for other approved purposes at the rate of RM2.00 per sq. metre per day subject to a minimum charge of RM20.00.

Section 38
Issue of Annual Pass and Renewal
(1)
For each issue of an Annual Pass to enter the Authority's premises a charge of RM5.00
will be made.
(2)
For each renewal of an Annual Pass to enter the Authority's premises a charge of RM2.00
will be made.
(3)
For each issue or renewal of an Annual Vehicle Pass to enter the Authority's premises a charge of RM10.00 will be made.
Part V
CONTAINER CHARGES
The charges in this Part shall normally be payable by vessel owners or their agents or shippers or consignees as the case may be, and shall be in addition to any charges applicable under Part I to IV.
Section 1
Full Container Load Charges (FCL)
The FCL shall apply-
(c)
When a loaded or empty container is discharged from a vessel, moved to the Container
Yard for storage whether for direct or subsequent delivery. The rate is inclusive of a lifting charge on delivery; or
When a loaded or empty container is received from a vehicle after unstuffing for storage in the Container Yard and subsequently removed to the vessel for shipment. The rate is inclusive of a lifting charge on receiving; or
When an empty container is discharged from a vessel, moved to the Container Yard for storage and subsequently removed to a Container Freight Station.
Section 2
Less Container Load Charges (LCL)
The LCL shall apply –
(b)
When a loaded container is discharged from a vessel, moved to the Container Yard for storage and subsequently removed to a Container Freight Station where the contents are unstuffed, stored and delivered to the consignees and the empty container is moved back to the Container Yard; or
When an empty Container is stuffed at a Container Freight Station and the reverse operations to (a) are performed.

Free Storage Period and Storage Charges -
(a)
The Free Storage period as specified under tariff item 41(ii) for import container shall be calculated from the date the container is received in the yard. For export container the free storage period shall be counted from the date of advice for export. Store rent charges shall be calculated after the expiry of the free storage period.
(b)
LCL cargo before stuffing or after unstuffing shall be charged break bulk store rent a transit storage rate. Storage for import cargo is calculated from midnight following the completion of unstuffing and for export cargo midnight following the receipt of the first lot of LCL cargo to the time of completion of stuffing.
Section 4
Extra Movement
The charge shall be applicable to all extra handling of containers not covered by the above conditions.
Section 5
Transshipment Container
The transshipment tariff shall only apply under the following conditions:
(a)
when it is discharged from the vessel onto the Authority’s premises and remains in the custody of the Authority until it is transshipped;
(b)
when it is transshipped in its original status within a period of 28 days from the time of completion of discharge of the first vessel to the time of berthing of the on-carrying vessel.
Container not transshipped within 28 days will be treated as import container and shall lose the right to concessionary rates. Store rent shall be charged retrospective from the date the container is received in the yard from the first vessel to the date of loading onto the on-carrying vessel;
(c)
the container must be manifested or declared in writing to be for transshipment to the Sabah
Ports Authority at least 24 hours prior to the arrival of the first vessel.
Section 6
Out of Gauge (OOG) Container
Out of Gauge (OOG) container means a container that is over-height, over-width, over-length or any combination of these.

(a)
Extra movement charge shall be levied on the container according to the number of extra movements involved.
(b)
Free storage days shall be calculated from the date the container is first received.
