Section 38
(a)
may conduct a course of study or training programme;
(b)
may conduct a course of study or training programme jointly or in affiliation, association or collaboration with any University, University College, higher educational institution, whether public or private, or professional body, within or outside Malaysia.
(1A)
No course of study or training programme shall be conducted by the private higher educational institution unless the private higher educational institution has been registered under section 24.
(2)
A private higher educational institution which contravenes the provision of this section shall be guilty of an offence and shall, on conviction, be liable to a fine not exceeding two hundred thousand

ringgit or to imprisonment for a term not exceeding two years or to both.
