Discharge of prisoners

Section 45
(1)
An Officer in Charge, or in his absence, the next senior prison officer on duty, shall be responsible for the due discharge of a prisoner immediately upon his becoming entitled to release, whether by—
(a)
the expiration of his term of sentence;
(b)
payment of fine;
(c)
pardon;
(d)
commutation; or
(e)
remission of sentence.

(2)
Subject to the approval of the Commissioner General and at the expense of the Government, a prisoner duly discharged from prison in accordance with this section may be returned to the place where the prisoner ordinarily resides.
