Section 96

Section 96

(1)

No person, fish factory, fishmonger, fertilizer factory, fish meal factory, fish wholesaler or restaurant owner, shall purchase fish caught by the use of explosive substance or explosive projectile or natural poisonous substance or poisonous chemical substance.

(2)

Any person, fish factory, fishmonger, fertilizer factory, fish meal factory, fish wholesaler or restaurant owner, who purchase fish caught by the use of explosive substance or explosive projectile or natural poisonous substance or poisonous chemical substance shall be presumed to have knowledge that such fish were caught by the use of explosive substance or explosive projectile or natural poisonous substance or poisonous chemical substance, unless the contrary is proved.

(3)

Any person who contravenes subsection (1) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding two years.
