(2)

Subsection (1) shall not be applicable to sections 26, 27 and 28

except where the circumstances under subsection (3) apply.

(3)

Where by reason of—

(a)

an error or omission by the person or by his registered trademark agent;

(b)

circumstances beyond the control of the person or by his registered trademark agent; or

(c)

an error or action on the part of the Trademark Office, an act in relation to an application for the registration of trademark or in proceedings under this Act (not being proceedings in a Court)

required to be done within a certain time has not been so done, the Registrar may extend the time for doing the act.

(4)

The time required for doing an act under subsection (3) may be extended even though that time has expired.
