Guidelines or practice directions by Registrar
(2)
The guidelines or practice directions issued by the Registrar
Trademarks 129
under this section shall be published in the Intellectual Property
Official Journal and shall be effective from the date as specified in the guidelines or directions.
(3)
Any person who are specified in the provision under this Act shall comply with the guidelines and practice directions.
(4)
The Registrar may vary, review or revoke any guidelines or practice directions.
(5)
Subject to subsection (4), the procedures set out in subsections (2) and (3) shall apply in respect of any variation, review or revocation of the guidelines or practice directions.
(6)
Any person, applicant or registered proprietor who does not comply with any guidelines or practice directions of the Registrar, where such guidelines or practice directions are applicable to such person, applicant or registered proprietor—
(a)
is deemed to have failed to fulfil the requirements as required by the Registrar which renders the application as withdrawn, lapsed, refused, revoked or as determined by the Registrar; or
(b)
commits an offence and shall, on conviction, be liable to a fine not exceeding ten thousand ringgit.
