Transitional
of Pathology Laboratory Act 2007
Any person who is operating or providing a pathology laboratory before the commencement of this Act and intends to continue to operate or provide the pathology laboratory on or after such commencement shall, not later than six months from the date of commencement of this Act, apply to the Director
General for a licence under this Act.
(2)
Pending the decision by the Director General on the application for a licence made under subsection (1), the applicant shall be deemed to be licensed under this Act and no action shall be taken against the applicant for operating or providing a pathology laboratory without a licence.
(3)
Where a licence is granted by the Director General under paragraph 16(a) pursuant to an application made under subsection (1), the applicant shall within six months from the date the licence is granted, take the necessary action to comply with the terms and conditions imposed in the licence, if any.
(4)
Where a licence is not granted by the Director General under paragraph 16(b), the applicant referred to in subsection (2)
shall cease to be deemed to be licensed under that subsection from the date the applicant is notified of the decision of the
Director General or, if there is an appeal under section 72, the date of the decision of the Minister on that appeal.
