Section 81

Section 81

(2)

Nothing in subsection (1) shall operate to prevent the disclosure of information where the disclosure is made—

(a)

for or in connection with the due administration of this

Act;

(b)

for the purpose of any legal proceedings;

(c)

for the purpose of any investigation conducted under this

Act;

(d)

in connection with any matter relating to professional disciplinary proceedings;

(e)

to a body established under any law regulating a healthcare professional;

(f)

to any counsel who is approved in writing by the client of the licensed pathology laboratory, requesting for the information which relates to any pathology services provided to that person;

(g)

to any person or any officer who is approved in writing by the Minister as a proper person to receive the information; or

(h)

for or in connection with the preparation by the Government of relevant health statistics or health registries in respect of the operation of this Act.

(3)

Any person who contravenes subsection (1) commits an offence and shall, on conviction, be liable to a fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding three years, or to both.
