Construction of implied agreements to keep “in repair”

Section 233
In the absence of any express provision therein to the contrary, any agreement to keep any building or part of a building
“in repair” implied in any lease or sublease (whether granted before or after the commencement of this Act)—
(a)
shall be construed in accordance with the definition of that expression contained in section 5, but
(b)
shall not be taken to require the building or part in question to be put into a better state of repair than that in which it was at the commencement of the lease or sublease.
