Section 11
An application for the establishment of a private higher educational institution shall not be approved by the Minister unless he is satisfied that—
(a)
the applicant is capable of providing adequate educational facilities for the establishment of the private higher educational institution;

(b)
the applicant is capable of providing adequate and efficient management and administration for the proper conduct of the private higher educational institution;
(c)
adequate measures have been taken to determine and maintain the standards of education provided by the private higher educational institution;
(d)
there is established a proper system of governance of the private higher educational institution with a constitution that shall be approved by the Registrar General; and
(e)
(Deleted by Act A1352);
(f)
no one who has been convicted of an offence involving fraud or dishonesty or who is an undischarged bankrupt is holding office as director, manager or secretary or other similar office or position.
