Power of lessees and sublessees to sublet for terms exceeding 3 years
of National Land Code (Revised - 2020)
(1)
Subject to sections 225 and 226, any lessee or sublessee for the time being of any alienated land may grant subleases of the whole or any part of the land comprised in his lease or sublease in accordance with the following provisions of this section.
(2)
Every sublease granted pursuant to this section shall be for a term exceeding three years.
(3)
Where any sublease so granted relates to a part only of any alienated land, the term thereof shall not exceed thirty years.
(4)
Every such sublease shall be granted by an instrument in Form 15b; and in any case where the sublease relates to a part only of the land comprised in the grantor’s lease or sublease, there shall be attached to the instrument a plan and description sufficient to enable the part to be accurately identified.
