Section 123
Articles held by the Railway Department and not covered by a Declaration Form or written instructions to store (which may be either general or specific, as required) are held by the Railway Department at the sole risk and responsibility of the owners or agents, subject to the payment of the prescribed charges.
(b)
Articles duly delivered to the Railway Department for storage are stored subject to the payment of the prescribed charges and to the condition that the Railway Department will not be liable for any loss, deterioration, mis-delivery or detention of or damage to such goods except upon proof that such loss, deterioration, mis-delivery or detention of or damage to such goods arose from the misconduct or negligence of the Railway Department or negligence of the Railway Department or its servants.
Limitation of liability for vehicles and for articles of special value delivered for storage.
