(2)
If goods are carried in any ship in contravention of subsection (1), the owner, agent, charterer and master shall be guilty of an offence and shall be liable to a fine of five thousand dollars; and the ship shall be deemed for the purpose of Chapter 31 to be unsafe by reason of improper loading.
