Section 52

(1)

Any stipulation made under section 51 by a seaman at the commencement of a voyage for the allotment of any part of his wages during his absence shall be inserted in the agreement with the crew, and shall state the amounts and times of the payments to be made.

(2)

Where the agreement is required to be made in a prescribed form, the seaman may require a stipulation to be inserted in the agreement for the allotment, by means of an allotment note, of any part, not exceeding one-half, of his wages in favour either of a near relative or of a saving bank.

(3)

Allotment notes shall be in such form as may be prescribed.

(4)

For the purposes of the provisions of this Ordinance with respect to allotment notes –

(a)

“near relative” means one of the following persons, namely, the wife, father, mother, grandfather, grandmother, child, grandchild, brother or sister of the seaman; and

(b)

“savings bank” means a savings bank approved by the Director.

(5)

In order to give effect to the provisions of this section, the Superintendent before whom a seaman is engaged shall, after the seaman has signed the agreement, inquire of the

seaman whether he requires a stipulation for the allotment of his wages by means of an allotment note, and if the seaman requires such a stipulation, shall insert the stipulation in the agreement with the crew, and any such stipulation shall be deemed to have been agreed to by the master.
