Extinction of right
of National Land Code (Revised - 2020)
(1)
The Land Administrator, where he is of the opinion that—
(a)
any person has failed to comply with any condition relating to the exercise by that person of a Land
Administrator’s right of way; or
(b)
it is inexpedient that a Land Administrator’s right of way should continue to exist, may hold an enquiry and thereafter order the right of way to be extinguished.
(2)
On the making of an order under subsection (1) extinguishing a right of way, the memorials made on the creation of the right of way shall be cancelled by the Land Administrator or, in the case of land held under Registry title or the corresponding form of qualified title, by the Registrar.
