Section 88
Except as provided for in paragraph (b) of this rule, the Railway Department will normally load and unload traffic at the places appointed for the reception and delivery of traffic. The Railway Department may require the consignor or consignee to load and unload dangerous and offensive goods, single packages or articles exceeding 600 kilogram in weight or traffic for transport from or delivery at stations or stopping places where the Railway Department have not the stuff available to undertake such work.
(b)
Unless otherwise agreed to the contrary, the following classes of traffic shall be loaded and unloaded by the consignor or consignee as the case may be:
(i)
traffic for transport from or delivery at private sidings or private godowns or depots: or
(ii)
traffic for transport from or delivery at sidings or other places on the premises of the Railway
Department not appointed for the reception or delivery of traffic; or
(iii)
special rate goods conveyed under classification C as specified in Appendix E; or
(iv)
loose goods or goods in bulk conveyed in truckloads; or
(v)
animals as defined in rule 3; or
(vi)
vehicles.
(c)
Notwithstanding the provisions of paragraph (a) of this rule, the Railway Department may permit the loading or unloading of traffic by the consignor or consignee as the case may be.
(d)
All loading and unloading of traffic undertaken by consignors or consignees shall be at their sole risk and responsibility. They shall also be responsible to make good the cost of repair to any wagon damaged during the loading and unloading operation.
