Section 38
Section 126 of the principal Act is amended—
of Road Transport (Amendment) Act 2026
(a)
in the shoulder note, by deleting the words “or grant licence”;
(b)
in subsection (1), by substituting for the words
“or grant a licence on such conditions as he may think fit to” the words “on such conditions as he may think fit”;
(c)
in subsection (2)—
(i)
by deleting the words “or licensed” wherever appearing;
(ii)
in paragraph (d), by deleting the word “and”
at the end of the paragraph;
(iii)
in paragraph (e), by substituting for the full stop at the end of the paragraph a semicolon; and
(iv)
by inserting after paragraph (e) the following paragraph:
“(f) to regulate the performance of functions of a road transport officer by the person authorized under subsection (1)
and to prescribe any penalty for non-compliance with any conditions imposed under subsection (1).”;
(d)
in subsection (3), by deleting the words “or licensed”;
(e)
in paragraph (5)(c), by substituting for the words
“officer authorized in writing by the Director General”
the words “road transport officer”;
Road Transport (Amendment)
(f)
in subsection (7)—
(i)
by deleting the words “or licensed”;
(ii)
by deleting the words “or licence”; and
(iii)
by substituting for the words “not exceeding ten thousand ringgit or to imprisonment for a term not exceeding two years or to both” the words
“of not less than five thousand ringgit and not more than ten thousand ringgit or to imprisonment for a term not exceeding two years or to both and, in the case of a second or subsequent conviction, to a fine of not less than ten thousand ringgit and not more than fifty thousand ringgit or to imprisonment for a term not exceeding five years or to both”; and
(g)
in subsection (8), by deleting the words “or granted a licence”.
