Repeal and savings
The Mental Disorders Ordinance 1952 [Ord. 31 of 1952], the Mental Health Ordinance (Sarawak) 1961 [Sarawak Ord. 16 of 1961] and the Lunatics Ordinance (Sabah) 1951 [Sabah Cap. 74] are repealed.
(2)
Notwithstanding the repeal of the ordinances in subsection (1)—
(a)
any mental hospital established and maintained, or hospital approved, under the repealed Ordinances immediately before the commencement of this Act shall be deemed to have been established, approved or appointed as a government psychiatric hospital under section 3 of this Act;
(b)
any appointment, subsidiary legislation, warrant or certificate made or issued under the repealed
Ordinances and in force immediately before the commencement of this Act shall continue to be in force and have effect as if it had been made or issued under this Act until superseded by an appointment, subsidiary legislation, warrant or certificate made or issued under this Act;
(c)
any such appointment, subsidiary legislation, warrant or certificate which is expressed to remain in force for a definite period shall not remain in force after the expiration of that period unless it is renewed in accordance with the provisions of this Act; and
(d)
any inquiry, trial or proceedings done, taken or commenced under the repealed
Ordinances immediately before the commencement of this Act may be continued or concluded under and in accordance with the provisions of this Act.
