(1)
Any master of a ship to which section 72 refers who fails to comply with the provisions of this Chapter with respect to –
(a)
taking charge of the property of a deceased seaman or apprentice;
(b)
making in the official log book the proper entries relating thereto;
(c)
procuring the proper attestation of those entries as required by this
Chapter; or
(d)
the payment or delivery of the property,

shall be accountable for the property to the Superintendent and shall pay and deliver the same accordingly and shall, in addition to paying and delivering the same accordingly, be guilty of an offence and shall be liable to a fine of treble the value of the property not accounted for, or, if such value is not ascertained, of five hundred dollars.
(2)
If any such property is not duly paid, delivered or accounted for by the master, the owner of the ship shall pay, deliver and account for the same, and such property shall be recoverable from him accordingly, and if he fails to account for and deliver or pay the same, he shall, in addition to his liability for the same, be guilty of an offence and shall be liable to a fine of treble the value of the property not accounted for, delivered or paid over, or, if such value is not ascertained, of five hundred dollars.
(3)
The property may be recovered in the same Court and manner in which the wages of seamen may be recovered under this Ordinance.
