Section 8
(1)
Every British or North Borneo ship required by regulations under section 277 to have certificated or authorized officers, when going to sea from any place in North Borneo, shall be provided with officers duly certificated or authorized under this Ordinance according to the scale prescribed for such ship.
(2)
The Governor, or a person designated by him in that behalf, may declare any officer to be an authorized officer for the purposes of this section:
Provided that –
(a)
such authorization shall subject to such conditions as may be endorsed thereon be valid for a period of six months only, but may from time to time be renewed in like manner and for a like maximum period;
(b)
before making any such declaration as aforesaid, the Governor or other person designated by him shall satisfy himself that the officer is competent to act as an authorized officer; and
(c)
no person shall be issued with such authorizations for a total period of more than two and a half years.
(3)
The master of every ship required by regulations under section 277 to have certificated or authorized officers, leaving or attempting to leave any port in North Borneo without having on board, and entered on the register or articles of agreement, officers possessing the prescribed certificates or authorizations shall be guilty of an offence and shall be liable to a fine of one thousand dollars; and the Port Officer may refuse port clearance in case of non-compliance with the provisions of this section.
