(2)

Save as provided in subsection (3) every person (whether he is a licensed hunter or otherwise) who shoots kills or takes a protected wild animal or a protected wild bird other than during the hours permitted and prescribed by the Minister in respect of the specified protected wild animal or protected wild bird pursuant to an order made under paragraph (2) of section 31, is guilty of an offence and shall on conviction be liable (in addition to any other

shall be deemed to have unlawfully shot killed or taken the wild animal or the wild bird (totally protected or protected as the case may require).

(a)

without a licence permit or special permit to do so;

penalty provided for any other offence) to a fine not exceeding five hundred dollars or to a term of imprisonment not exceeding three months or to both.
